Aetna, Optum denied re-assessment in attraction towards chiropractors

Aetna Inc. has been denied trial of a fourth district decision that resurrected the group’s allegations that the insurer had conspired with Optumhealth Care Solutions to overcharge patients for chiropractic and physical therapy services.

The companies asked the U.S. Fourth District Court of Appeals to reconsider its June decision to reanimate a lawsuit under the Employee Retirement Income Security Act over their accounting practices. The court allowed health insurer Sandra Peters to apply for various forms of relief under ERISA without demonstrating any personal financial loss associated with the conduct of the companies.
